We are considered to be dumb

            We here at Common Sense University are getting very close to conclude that the vast majority of Americans are considered to be stupid or dumb. We base this on a recent event where the votes of over seven million California voters were overturned by a reportedly gay judge as he adjudicated a case that was filed by opponents of Proposition 8, passed in November 2008. This proposition simply stated that marriage should be considered the union between a man and a woman and a majority of voters in California agreed with that.

            However, Chief Judge Vaughn R. Walker of the U.S. District Court for the Northern District of California disagreed with the voters and ruled the new law to be unconstitutional! In his 136 page legal dribble, he stated among other things: “The evidence shows that, by every available metric, opposite-sex couples are not better than their same-sex counterparts; instead as partners, parents and citizens opposite-sex and same-sex couples are equal”

            Your Honor, with all due respect: “How many same-sex couples do you know that have been able to conceive a child biologically? There is no difference between opposite-sex and same-sex couples? Or are you saying that being able to conceive children is not an available metric?”

            And one more thing, dear average citizens: The fact that this judge is reportedly gay had absolutely nothing to do with his decision. Yeah, right! If this is not evidence that we, the citizens of America are considered too dumb to understand these complex issues than what is? Never mind that throughout our human history marriage was considered the union of a man and a woman in all cultures and religions. But the judge simply did not see this as such, for him, the unfairness of not allowing the legalization of same-sex marriages trumped history and what we consider common sense and rationality. To him it was so unfair to continue the ‘suffering’ of gays and lesbians by denying them the right to marry and with his ruling he created for now three categories of matrimony in case his ruling will be upheld in the Ninth Circuit of Appeals and eventually the U.S. Supreme Court: The three versions of marriage will be: Husband-wife, husband-husband and wife-wife!  

            And how would we handle the suffering of threesomes in the future? You know, three men or three women together in love with each other or any combination thereof. Do we have a right to deny them their desired happiness in matrimony when they come asking for it? Only time will tell what consequences this ruling might bring us in the future. It’s a slippery slope and this ruling could be used for future social distortions of unimaginable proportions.

            We are not surprised that it took Judge Walker 136 pages to come up with this legal contortion. And while legal scholars and lawyers delight in Judge Walker’s brilliance, it is us, the people of America, whose collective majority opinions are just dumped. Our voting rights are trampled on and the long-standing acceptance of majority rule is thrown out the window, or simply stated, is taking away from us. Is it any wonder that the participation in elections is decreasing in terms of numbers? It is exactly these types of arrogant judicial decisions that makes people believe that their votes are meaningless, that their voting rights are unimportant. And that is a shame for our country, the greatest country under the sun. We truly believe that these ‘judicial rulers’ simply have reached a level of arrogant superiority that they believe that we, the average citizens of America, are quite simply too dumb to make decisions on such important issues. Shame on us if we simply accept this without at least putting up a fight.
