It’s now legal to be an Illegal
There are many situations and happenings that causes someone to shake one’s head due to its total irrationality and indefensible content and nature. The recent ruling by Clinton-appointed Federal Judge Susan Bolton is one of them when she partially struck down a perfectly legitimate Arizona State Law and thus preventing Arizona to enact it. This is the case where the United States Government sued the State of Arizona to prevent enactment of this new state law.
The judge’s decision is a classic example of what is known as activist jurisdiction compared to adjudicating laws in accordance with the United States Constitution. She took her time in her decision, an indication that is was not easy to come to her liberal leaning decision. All the Arizona Law was supposed to do was to essentially do what is part of United States Law. But that was just not the right thing to do in the judge’s mind. She simply could not have Arizona law enforcement members – sheriff deputies and policemen – ask a person that had been stopped for an unlawful act if they were legal residents or citizens of America. No, that could be racial profiling or intimidation especially if the person stopped was illegally in this country. That was only permissible for United States law enforcement personnel to do and if the United States Government could not adequately provide law enforcement personnel, then so be it.
Let’s remember what brought this new State law about in the first place: Arizona had been and still is literally overrun by people entering the country illegally including drug runners, weapons smugglers and the like and since their (Arizona’s) cries for help to the Federal Government went unanswered, the State legislature decided together with the Governor that they had to do something to protect its citizenry from the multitude of these illegal aliens by identifying them once they were stopped due to another unlawful activity. Simply asking someone during the course of a traffic stop or another potentially criminal activity: “Are You a legal resident or citizen in America” was however considered beyond the pale and the judge could not let that happen.
While the State of Arizona has appealed the decision to the Ninth Circuit Court of Appeals and will most likely have it reviewed and decided by the United States Supreme Court some time in the future, in the meantime we can present the following paradox:
It is Legal to be in America Illegally
It is Illegal to ask someone if they are Legal
What is this world, specifically America coming to and people should ask themselves the same question when these things are happening in our midst. It is totally illogical and lacks even an ounce of common sense yet it is a shining example of Liberalism.
